According to a report by Newsmax on Friday, December 22, 2023, three Republican state lawmakers have announced their intention to draft legislation aimed at removing President Joe Biden from the ballot in crucial swing states, including Arizona, Georgia, and Pennsylvania.
State Representatives Aaron Bernstine of Pennsylvania, Charlie Byrd of Georgia, and Cory McGarr of Arizona revealed their plans in an exclusive statement to Breitbart on Friday.
Citing concerns over what they term as “lawfare” directed at former President Donald Trump, the lawmakers argue that their initiative is a response to the recent decision by the Colorado Supreme Court to exclude Trump from the state’s ballot.
The court, in a 4-3 ruling, invoked the 14th Amendment’s insurrection clause as grounds for removal. Constitutional scholar Alan Dershowitz, however, has indicated that he expects the U.S. Supreme Court to overturn this decision, emphasizing that the power to define and act on insurrection lies solely with Congress, not state courts.
Undeterred by the potential reversal of the Colorado ruling, Bernstine, Byrd, and McGarr are taking a proactive stance.
According to Breitbart, the lawmakers conveyed their motives, stating, “We are joining forces to introduce legislation to remove Joe Biden from the ballot in Georgia, Arizona, and Pennsylvania.”
They further contend that the removal of Trump from the Colorado ballot sets a dangerous precedent that threatens the integrity of the American political system for years to come.
Highlighting the perceived inconsistency in the application of the law, the lawmakers argue that, by the same legal interpretation that led to Trump’s exclusion, Joe Biden should be considered ineligible to run for political office.
“The absurdity of radical Democrat judges removing Donald Trump from the ballot in Colorado will be a stain on the American political system for decades.”
“By their very own interpretation of the law, Joe Biden is 100% not eligible to run for political office,” they asserted.
