    Former Marine Daniel Penny has spoken out for the first time since being acquitted of criminally negligent homicide in the death of convicted felon Jordan Neely.

    As Jim Hoft reported, Penny on Monday was found not guilty after more than 24 hours of deliberation across five days. Penny had pleaded not guilty to charges of second-degree manslaughter and criminally negligent homicide following an altercation in which he placed Neely in a chokehold.

    The prosecutors later dropped the manslaughter charge to con the jury into finding Penny guilty of the ‘lesser’ charge.

    The trial of Penny centered around the events on May 1, 2023, when an unhinged Neely boarded an F train, displaying erratic behavior, including shouting threats at passengers. Penny placed Neely in a chokehold, a technique he had learned during his military service, for several minutes, after which Neely stopped moving and was later pronounced dead.

    Nelly had been arrested 42 times over the past decade for various offenses including trying to kidnap a little girl. At the time of his death, Neely had an active warrant for an alleged assault.

    While speaking to Fox News’s Jeanine Pirro on Tuesday, Penny admitted he was uncomfortable talking about speaking to the media (who can blame him?) but made clear he was not a violent human being.

    “I’m not a confrontational person,” Penny said. “I don’t…This type of thing (interview) is very uncomfortable.

    “All this attention and limelight is very uncomfortable. I would prefer without it.”

    Penny went on to say that he is not seeking attention or approval from the public. At the same time, he rightfully expressed no regrets for his actions.

    “I didn’t want any type of attention or praise and I still don’t,” Penny stated. “The guilt I would have felt if someone did get hurt, if he (Neely) did do what he was threatening to do, I would never be able to live with myself.”

    “I’ll take a million court appearances and people calling me names and people hating me just to keep one of those people from getting hurt or killed,” he added.
